A strata title is a separate title for each unit in a building, with lifts, pools and other common areas owned jointly by all the owners. An individual title is a separate title for a plot of land, the usual form for a landed house. Both are formal titles issued by the state land office; the difference lies in what you own and what you pay each year.

In one line: buy a condo or serviced apartment and you get a strata title, paying maintenance to the management body; buy a landed house and you usually get an individual title, owning the land and paying quit rent yourself. Gated and guarded landed schemes can also be held under strata title.

What is a strata title?

When a multi-storey building stands on one piece of land, the land office issues a separate title for each unit in it. The FAQ of the federal Department of Director General of Lands and Mines (JKPTG) explains the terms you will meet:

  • Parcel (petak): the residential or commercial unit you buy.
  • Accessory parcel (petak aksesori): a space used with your parcel, such as a car park bay or balcony. It cannot be sold separately from the parcel.
  • Common property (harta bersama): everything not inside a parcel, such as lifts, stairs, the multipurpose hall, the refuse room, access roads and the pool.
  • Share units (unit syer): the weighting given to each parcel. It sets your vote at general meetings and your share of the maintenance charges.
  • Management corporation (MC): comes into being when the strata register is opened. It consists of all parcel owners and owns the common property.

When is the strata title issued?

Under clause 12 of the Schedule H agreement, the developer must apply for strata titles at its own cost before vacant possession, and clause 27(1)(b) makes an issued strata title a condition of handing over the keys. If the title has not been issued for a reason not of the developer’s making, the developer needs a written certificate from the Controller of Housing before handing over (clause 28(1)).

The Act also sets deadlines: the developer must apply for the certified proposed strata plan within 3 months of the main structure being certified, and for the strata titles within 1 month of the plan’s approval, each extendable once. Failing to apply carries a fine of up to RM100,000 or up to 3 years’ jail. The titles are first registered to the developer and then transferred to you on Form 14A.

What is an individual title?

Land already held under a final title is subdivided into two or more lots, each with its own title (National Land Code s.135, which speaks of "separate titles"). A landed housing scheme does this with its mother title, one title per house.

Titles come as qualified titles, not yet finely surveyed, and final titles, surveyed by the mapping department and certified by the State Director of Survey.

Qualified title Becomes, once final
H.S.(D) Geran (freehold) or Pajakan Negeri (leasehold)
H.S.(M) Geran Mukim (freehold) or Pajakan Mukim (leasehold)

The Selangor land office notes that conversion from qualified to final title normally happens without the owner applying, and that the title and lot numbers change when it does.

Landed homes can be strata too

Since a 2007 amendment, landed housing can be held under strata title (Act 318, s.6(1A)), each plot being a "land parcel" with buildings of no more than four storeys. The Ministry’s planning guideline GP022 explains that such a gated community is managed by the owners through a management corporation, whereas a guarded neighbourhood on individual titles has no basis in law and rests on residents’ voluntary arrangements.

How to check a unit’s title

Order an official land search (carian rasmi). The Johor land office charges RM150 per title (2026 fees), with up to five titles per counter form, and searches can also be ordered online through iTanah Johor, after a one-time fingerprint verification at a land office for official searches. An official search carries the Registrar’s seal; a private search does not.
